February 22, 2026Generally, I post blogs about e-discovery. However, I have had the honor of representing the President of the County Council of Harford County, Maryland, in the Circuit Court, and as appellee in the Appellate Court.
The appeal centers on the application of Art. XV, §2, of the Maryland Constitution. Under that provision, in part, any elected official who, during the term of office, enters a plea of no contest (or nolo contendere) to a felony is removed from office by operation of law and the office is deemed vacant.

The appellant speaks first, for approximately 15 minutes. I then spoke for 20 minutes, and the appellant had a 5 minute rebuttal. My argument starts at 15:47.
